{"id":21136,"date":"2025-02-19T15:00:39","date_gmt":"2025-02-19T15:00:39","guid":{"rendered":"https:\/\/satellite.mmu.ac.uk\/northernquota-old\/?p=21136"},"modified":"2025-02-20T12:39:34","modified_gmt":"2025-02-20T12:39:34","slug":"david-conn-calls-for-duty-of-candour-on-officials-ahead-of-hillsborough-law","status":"publish","type":"post","link":"https:\/\/satellite.mmu.ac.uk\/northernquota-old\/david-conn-calls-for-duty-of-candour-on-officials-ahead-of-hillsborough-law\/","title":{"rendered":"David Conn calls for \u2018duty of candour\u2019 for officials ahead of Hillsborough Law"},"content":{"rendered":"\n<p>Reporter of the year David Conn has called for a &#8216;duty of candour&#8217; to be placed on police as campaigners call for a Hillsborough law to be introduced within the year.<\/p>\n\n\n\n<p>Conn was joined by legal experts from Garden Court North Chambers at a memorial lecture in the University of Manchester on Thursday, honouring of Hillsborough barrister Mark George, who represented 22 families following the disaster.<\/p>\n\n\n\n<p>The lecture discussed failures in the legal system in the years after the disaster. Named the UK\u2019s current news reporter of the year, David Conn has spent decades as an investigative journalist for The Guardian, and was among the original wave of reporters who covered Hillsborough from the start.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"768\" src=\"https:\/\/satellite.mmu.ac.uk\/northernquota-old\/wp-content\/uploads\/sites\/437\/2025\/02\/DSC00287-1024x768.jpeg\" alt=\"David Conn, a thin white man with a bald head, leans back on a chair with his hands on his lap. But I obviously understood that this was a huge injustice that had happened and I wanted to write about that.<\/p>\n\n\n\n<p>&#8220;I ended up having a chapter in that book called The Rebuilding Process about the rebuilding of the football grounds that happened as a result of the of government forcing the grounds to become safe and all-seater.<\/p>\n\n\n\n<p>&#8220;They were given grants worth up to \u00a3200m to help them build the stadiums, and at the same time the Hillsborough families had no money, no public funding for legal representation, and were lost in this nightmare legal system.&#8221;<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">Today we remember those who tragically lost their lives in the Hillsborough disaster 35 years ago.<br><br>The thoughts of everyone at Nottingham Forest are with all those who have been affected \u2764\ufe0f <a href=\"https:\/\/t.co\/WYpxfyGV56\">pic.twitter.com\/WYpxfyGV56<\/a><\/p>&mdash; Nottingham Forest (@NFFC) <a href=\"https:\/\/twitter.com\/NFFC\/status\/1779778465014698095?ref_src=twsrc%5Etfw\">April 15, 2024<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<p>It was in researching this chapter that he first met Phil and Hilda Hammond, whose 14-year-old son Philip was killed in the stadium.<\/p>\n\n\n\n<p>\u201cPhil was the vice-chair of the Hillsborough Family Support Group,\u201d he said. \u201cA wonderful man. [He and Hilda] were wonderful people, a wonderful couple.<\/p>\n\n\n\n<p>\u201dI ended up staying there for three hours, sitting around in the kitchen talking about all these issues, and they really opened my eyes to it. I took so much from that into the book, and even after that, as I made my way in journalism and tried to have other opportunities, I always wanted to to take every possible opportunity to raise the Hillsborough injustice.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Anfield speech<\/h2>\n\n\n\n<p>Just over a decade later, the 20th anniversary of the Hillsborough disaster was marked by a memorial held in the Anfield football ground, with a speech by Andy Burnham, who also spoke at Thursday\u2019s lecture. He said his decision to go through with the Anfield speech was a direct result of Mr Conn\u2019s reporting.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">Justice for the 96. Anfield&#39;s response to Andy Burnham&#39;s speech at the 20th Hillsborough memorial is profound. <a href=\"https:\/\/t.co\/W8XI4ZfGhZ\">https:\/\/t.co\/W8XI4ZfGhZ<\/a><\/p>&mdash; Rousing The Kop (@RousingTheKop) <a href=\"https:\/\/twitter.com\/RousingTheKop\/status\/853373640695590913?ref_src=twsrc%5Etfw\">April 15, 2017<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<p>&#8220;I was Secretary of State for Culture, Media and Sport, and I received an invite to the 20th anniversary of Hillsborough, and I agonised about whether or not I should go because I didn&#8217;t know how I could handle it,&#8221; he said.<\/p>\n\n\n\n<p>&#8220;I&#8217;d been invited by Steve Rotherham, who was then Lord Mayor of Liverpool, with the consent of Margaret Aspinall, the chair of the Hillsborough Family Support Group. She&#8217;d made an exception and said they would invite a politician, but I didn&#8217;t know what to do. <\/p>\n\n\n\n<p>\u201cI&#8217;d been invited, and obviously as somebody born in that city, I kind of felt I had to go. But I didn&#8217;t know what I was going to say, because how could I? What could I say, representing a government that had let the city and the people down?<\/p>\n\n\n\n<p>&#8220;In that moment, I read an article from David. Days before the 20th anniversary, he laid out this painstaking research he&#8217;d done on the statements, and David being David, he was the only person that had gone through, in his meticulous way, line-by-line, every single statement. I decided to work with my colleague, Maria Eagle, even though we had no cabinet cover for what we were doing. We made a public call via David in The Guardian calling for full disclosure of all the Hillsborough papers to at least give the families the truth.&#8221;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">New inquiries<\/h2>\n\n\n\n<p>A total of 300,000 documents were released following the public call. The Hillsborough Independent Panel was set up to go through the previously unseen evidence, and two years later, would come out with a <a href=\"https:\/\/assets.publishing.service.gov.uk\/media\/5a7c9e4840f0b65b3de0a0ff\/0581.pdf\">damning report<\/a> that led to the original inquests being overturned, and a fresh wave of inquiries being launched.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">19 December 2012. The verdicts of \u201caccidental death\u201d on the then 96 victims of the 1989 Hillsborough disaster were all quashed in the High Court. Relatives of the victims felt vindicated in their 23-year campaign for justice. A 97th victim, Andrew Devine, was added in 2021. <a href=\"https:\/\/t.co\/1fxI1FeR9I\">pic.twitter.com\/1fxI1FeR9I<\/a><\/p>&mdash; Prof. Frank McDonough (@FXMC1957) <a href=\"https:\/\/twitter.com\/FXMC1957\/status\/1869668007154237815?ref_src=twsrc%5Etfw\">December 19, 2024<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<p>Though the news was celebrated by families and advocates, Mr Conn\u2019s faith in the legal system remained slim. <\/p>\n\n\n\n<p>Two South Yorkshire police officers and a solicitor were charged with perverting the course of public justice for amending the police statements used in the original inquiry, <a href=\"https:\/\/www.bbc.co.uk\/news\/uk-england-merseyside-57172900\">but were acquitted<\/a>: the original inquiry was not about public justice, and so they could not be accused of perverting it. <\/p>\n\n\n\n<p>\u201cHe [Mr Justice William Davis] notes of solicitors that they must not \u2018positively mislead\u2019 a court,\u201d Mr Conn said. \u201cBut if they realise the court is acting on a false basis,<a href=\"https:\/\/www.lawgazette.co.uk\/law\/hillsborough-solicitor-had-no-duty-to-correct-the-court\/5108650.article\"> they have no duty to correct the court.<\/a> Where is the duty of candour for the lawyers?\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">&#8216;A duty of candour&#8217;<\/h2>\n\n\n\n<p>Imposing a duty of candour on official bodies is the key aim of the <a href=\"https:\/\/hillsboroughlawnow.org\/\">Hillsborough Law Now<\/a> campaign, of which both David Conn and Andy Burnham are vocal supporters. It has the potential not just to force public officials to tell the truth proactively, but it also establishes a level playing field for victims of disasters and outrageous things like this so that
